The following terms and conditions apply to all competitions for IC Music And Apparel GmbH on www.nuclearblast.com
1. Participation
1.1. Participation is free and without any obligation for the participant
1.2. Participation is only possible during the period listed in the competition
1.3. Participation is open to people over the age of 18. Those under the age of 18 require parental consent. Any lack of consent leads to exclusion from the competition.
1.4. Employees of IC Music and Apparel GmbH as well as cooperation partners involved in the processing or creation process of the competition are not permitted to enter.
1.5.In the instance of false statements or multiple entrees, IC Music and Apparel GmbH is entitled to exclude any persons falling within these categories from the competition.
2. Consent to Receive Newsletters
2.1. By participating in the contest and confirming the participant's email address through the double opt-in procedure, the participant agrees to receive the Nuclear Blast newsletter. This newsletter provides regular updates on current offers, promotions, and news about Nuclear Blast.
2.2. The participant's data will not be shared with third parties. The participant can revoke their consent at any time by unsubscribing from the newsletter. Each newsletter contains an appropriate unsubscribe link.
3. Settlement
3.1.A payment of the prize in cash, its exchange or transfer to another person is not possible. If you do not win the prize, the next person will be selected - Failing this, another winner will be determined. The prize is usually sent by mail to the address supplied by the winner.
3.2. The winner will be notified by e-mail
3.3. IC Music And Apparel GmbH is entitled to transfer the winner's data to the respective cooperation partner.
3.4.The item displayed as the prize in the competition is not necessarily identical to what may be received. There may be deviations in terms of model, colour or consistancy. Should the prize not be available in the advertised version, the winner will receive an equivalent replacement.
4. Manipulation
4.1. Any kind of manipulation to the specified competition is prohibited. This includes amongst other things, the use of automated prize systems as well as other technical methods of manipulation.
5. Consequences of violations
5.1.IC Music and Apparel reserves the right to exclude those who violate the terms and conditions of the competition at any time. The winner can be withdrawn from the competiton if incorrect personal data has been provided or in the case that manipulation of the competition has occured. In this instance, the prize can be withdrawn without replacement. The prize can also be reclaimed at any time.
6. Liability and Content responsibility
6.1. In case of material and/ or legal defects to those donated by cooperation partners, IC Music And Apparel is not liable. Nuclear Blast acts here as a representative of the cooperation partner and defects have to claimed from them. When asserting claims for defects the contact details of the cooperation partner will be supplied to the winner.
6.2. The legal responsibility of copyright, personality or trademark law as well as other laws lies exclusively with the competition participant. Furthermore, the partipant undertakes the right to respect their own image and not to upload photos from and with third party parties (who have not expressed consent for this to be used).
7. Privacy

7.2.The participant agrees that their submissions to the competition and the personal data supplied (first name, last name, place) can be published.
7.3. It is possible to object to publication at the time of participation or subsequently.
7.4. We process personal data of contest participants only in compliance with the relevant data protection regulations, insofar as the processing is necessary for providing, conducting, and handling the contest (Art. 6 Para. 1 Sentence 1 lit. b DSGVO), the participants have consented to the processing (Art. 6 Para. 1 Sentence 1 lit. a DSGVO), or the processing serves our legitimate interests (e.g., for the security of the contest or for the protection of our interests against misuse by possible collection of IP addresses when submitting contest entries). The participants' data will only be transmitted to other parties if this is necessary for the conduct of the contest (e.g., for shipping prizes) or if a participant has consented to the transmission. The processed personal data (email address) are mandatory for participation and conduct of the contest. They will only be passed on to companies involved in conducting the contest or handling the prizes.
7.5. To be able to send prizes to the winners, they will be contacted by Nuclear Blast at the end of the contest via the provided email address so that the prizes can be delivered. Participants are informed within the contest about which information is required for participation. The participants' data will be deleted once the contest or competition has ended and the data is no longer needed to inform the winners or because follow-up questions about the contest are expected. Generally, participants' data will be deleted at the latest six months after the end of the contest. Winners' data may be retained longer, e.g., to answer queries about the prizes or fulfill prize services; in this case, the retention period depends on the nature of the prize and is, for example, up to three years for items or services to be able to handle warranty cases.
7.6. Additionally, participants' data may be stored longer, e.g., in the form of reporting on the contest in online and offline media. If data was also collected for other purposes within the context of the contest, their processing and retention period are based on the data protection information for that use (e.g., in the case of newsletter registration within the context of a contest).
7.7. The participant has the right to object at any time to the processing of their personal data for reasons arising from their particular situation, which is based on Art. 6 Para. 1 lit. e or f DSGVO; this also applies to profiling based on these provisions. If personal data concerning the participant is processed for direct marketing purposes, the participant has the right to object at any time to the processing of their personal data for such marketing; this also applies to profiling insofar as it is related to such direct marketing. 7.8. Right of withdrawal for consents: The participant has the right to revoke consents given at any time.
8. Other
8.1. The right of recourse is excluded.
8.2. If any of the provisions should be or remain invalid, the validity of the remaining terms of use are unaffected.
8.3. These terms of use may be changed at any time by IC Music and Apparel GmbH without notification.
